Purchasing houses and land from real estate agents in
Greece and the Greek islands
If you are buying your property in Greece through a reliable local
real estate agent, they should be able to give you all this
information in writing. If you are buying the plot of land from
a private owner, then do ensure that the land is legally large
enough to accept the size of the building and that you have a
topographic survey prepared and signed by a reliable architect
that shows the boundaries. Precise boundary distance
requirements must be met. The topographic survey will be
attached to your contract of purchase and is a legal document.
Do not put down any deposit until you have this survey.
Before purchasing land in Greece a certificate from the Forestry
Authority must be issued to allow you to build upon that piece
of land it has also to be officially checked for access to water
and electricity and, in some areas, for archaeological remains.
This is carried out by the Archaeological Authority who must
carry out an on-site visit and takes about two and a half months
from application to certificate. If services are not already
connected then you will need to factor in the cost of
electricity poles, water pipe connections and a possible
cistern.
Poor road access is not always negative if it means the cost of
the plot is lower and gives privacy. Eventually plots around the
same area will be built upon and roads will be improved by the
council. Be aware however that a steep plot can add to
excavation costs and debris transportation but the advantage is
that there is no risk of future visual obstructions. When
choosing a plot, views are of vital importance. Sea views are
obviously the first choice, but a plot with countryside or
mountain views or sunrise./sunset can be charming and cheaper. A
contract for the purchase of the plot must be drawn up by a
Notary and have a layer present at the signature.
All land must be registered at 1 of the 2 land registry offices
in Greece. Once this has been approved the land is officially
yours
Useful organizations to Contact when buying real estate in
Greece
The
Building License Office (Poleodomia). Deals with licenses to be
issued before a new building or renovation starts. The civil
engineers undertake and issue the required license. The Social
Security Combination (IKA). Most of the building works require
social contribution payments for the people employed in the
building. the engineer is the one who will tell the owner,
according to the area and the work undertaken, the amount of
money to be paid for IKA. Tax Office (Eforia). the Tax Office may
ask (even years later) where the owner found the money to pay
for the building work or renovation. (It's a good idea to take
advise from an accountant on this before work begins). You need
to prove that money was transferred from England (if that was
the case) and so taxed there, otherwise it will be taxed again
in Greece. TEE Is an English speaking union for
engineers. Commercial Epimelitirio - is where all the workers,
engineers, accountants are registered and they can provide
information about their members. Architects and engineers may
belong to an organization called Europe (Architects Europe) and
to the Greek Chamber of Commerce. Read about

Using real estate agents ,realtors and other
professionals in Greece
It is advisable for prospective buyers to buy through a Greek real
estate agent and to also have a Greek lawyer who will do the job efficiently and
far less expensively than a foreign lawyer. A local Greek lawyer will know the
local market and can ensure all the main paperwork is done properly, including
legal obligations like the Greek tax return Plus
Furthermore, it is definitely worth the extra cost to let a reliable estate
agent deal with the whole process, especially for new build and if you are not
always in Greece to oversee the development of the project. they can keep you
up-to-date and sort out any problems. there is often less of a language barrier
when you go through an agent and all legal documentation can be translated from
Greek into your own language.
You must ensure that you tell the property agent exactly what you are looking
for. What size plot or property are you looking for, what location are you
looking for - rural, in a town or village, by the sea, if you are buying a
property in Greece do you wish one with land, does your wish list include sea
views, a southerly orientation, privacy, within walking distance of taverns and
beach, no road noise but still reasonably accessible, within an hour's drive of
the airport, would steps or steep access be a problem?... and so on. Don't be
afraid to ask lots of questions to local real estate agents and building
professionals.
According to the law when you sign a contract to purchase a property or land,
the Notary Public, lawyer present during the contract exchange, the architect
who prepared the topographic survey (which forms part of your contract) and the
estate agent, all share responsibility. the estate agent's details will be put
onto the contract and therefore they are obliged to share responsibility, by
law, if something goes wrong.
By not going through an estate agent you have one less party to be working on
your behalf and in your interests. After your purchase, you will have many
queries and you will feel more comfortable to know there is an office with
English-speaking personnel to assist you. Some agents also offer an after-sales
service which includes home management, rental, maintenance, cleaning and
gardening and seasonal opening/closing and some agents pay for your viewing
flight out to Greece.
Before you hand over a single euro, ask for a copy of the most Topographic
Survey and take this to an independent English-speaking notary or lawyer. If the
seller does not have a survey visit an architect and arrange for a Topographic
Survey to be carried out, in the presence of the vendor, to establish the
boundaries and ensure the plot is big enough to legally accept a building. If
the plot is outside the village/town limits it is very important to ensure the
Forestry Authority gives the Certificate to Build, without which you cannot
apply for a Building Permit.
A Lawyer must be employed to carry out a search on the property at the Land
Registry. A Notary must draw up a contract for purchase and the notary will
request certain papers from the vendor. Do not ever buy land or property without
a contract drawn up by a notary. If you can, use an English-speaking Estate
Agent, as they will be working on your behalf to make sure the sale goes
smoothly and legally. Contracts are in Greek but you can pay for a validated
translation to be made. The land may be cheap to buy, but it could be an
expensive mistake if all you can do is look at it and cannot build upon it.
